I chair a community sports club that is an incorporated society. Members mention that a new law requires us to update our rules and re-register. What has changed and what happens if we do not comply? I am not sure where to start or who I should be contacting about this.
The Incorporated Societies Act 2022 replaced the old 1908 Act and requires existing incorporated societies to re-register under the new Act by the transition deadline, which has passed or is close depending on when you read this, so check the current position with the Companies Office immediately. The new law requires societies to have a constitution meeting new minimum standards, a committee of at least three members, officers with defined duties, a dispute resolution procedure and a register of members. A society that fails to re-register within the transition period risks being removed from the register and losing its legal status, which can affect its ability to hold property and its members' limited liability. Consult the Companies Office guidance and a lawyer if your rules need extensive amendment.
