I cannot afford a lawyer, and my ex has a large amount of savings and can pay for a very expensive lawyer. I fear that I will be at a disadvantage in a Family Court dispute about our children. Is legal aid available for family cases?

Legal aid is available for many family matters, including care of children, protection orders and relationship property, under the Legal Services Act 2011. You must meet the financial eligibility criteria, based on your income and assets, and the case must have reasonable prospects of success, and you must apply through the Ministry of Justice and choose a lawyer who provides legal aid services. Legal aid is generally a loan that must be repaid, though repayment rules differ for some types of matter, so ask the legal aid provider how it applies to you. Free advice is also available from community law centres and family legal advice services, and the Family Court offers Family Dispute Resolution at no charge for eligible parents. Ask a legal aid lawyer to assess your eligibility and the type of assistance available.
