My builder has stopped work and wants more money

We own a large residential section and are considering subdividing it into two titles to build a second house or sell part of the land. We do not know where to start or how long the process typically takes. What approvals do we need?
Subdivision is regulated under the Resource Management Act 1991 and generally requires a subdivision resource consent from your council, assessed against the rules in the district plan covering matters such as minimum lot sizes, access, services and infrastructure. You will likely need survey plans prepared by a licensed cadastral surveyor, and depending on the site, engineering reports covering stormwater, wastewater and access may be required. Once consent is granted and any conditions such as new services or esplanade strips are satisfied, a survey plan is deposited with Land Information New Zealand to create the new titles, a process that itself can take time. Timeframes vary significantly depending on complexity, council processing times and whether any objections or notified consents are involved, so budget for several months at a minimum. Engage a planner or surveyor early to assess feasibility and costs before committing.
