My partner and I are separating after a long relationship. I have been contributing to KiwiSaver for years, and my partner is claiming half of it. I thought retirement savings were personal. Is KiwiSaver shared?
KiwiSaver can be relationship property. Under the Property (Relationships) Act 1976, superannuation and retirement savings accrued during the relationship are generally treated as relationship property, and the part built up during the relationship is usually divided equally, while contributions made before the relationship or after separation may be separate. The way it is shared can be by a transfer of funds between the KiwiSaver accounts, done through a court order or agreement, without needing to withdraw the money. Include KiwiSaver statements in the disclosure of relationship property, and a lawyer or accountant can work out the split by calculating the balance at the beginning of the relationship and the date of separation. Make sure any agreement is documented properly.
