I plan to sell branded goods from suppliers on my website, using the brand names and images from the manufacturers. Some say I need permission, others say it is fine because the goods are genuine. What is the legal position?

Selling genuine goods you have lawfully acquired is generally permitted, and under the Trade Marks Act 2002, the owner's rights are exhausted for goods that were placed on the market with their consent, including through parallel importing. However, using the brand's logo or name in a way that suggests you are an authorised dealer or affiliated with them can be misleading and infringe trade mark rights or breach the Fair Trading Act 1986. Copying the manufacturer's product photographs and descriptions from their website may also infringe copyright, so use your own images or obtain permission. Use the brand name factually to describe the goods, and if you are not an authorised dealer, make that clear. Check any distributor agreements for restrictions, and ensure goods are not counterfeit.
