A ministry has told me that I need to be on an approved panel before I can be considered for work in my field. I have not heard of this before. How do panels work, and how do I get on one? I want to make sure I am not missing anything important before I decide what to do.

A panel arrangement is a list of pre-approved suppliers established through a competitive process, typically for a set period, from which agencies can purchase goods or services without running a full tender each time. There are all-of-government contracts, negotiated by New Zealand Government Procurement, and agency-specific panels. To be included, you must respond to the invitation to join, which is normally advertised on GETS, meeting the eligibility criteria such as capability, financial standing, insurance, references and pricing. Once you are on the panel, agencies select suppliers based on the terms of the panel, for example through a mini-competition or direct offers. Check whether the panel is open for new members, since panels may be closed until a refresh, and ask when the next opportunity is.

I work for a council and I have been asked to sit on a panel evaluating a tender. One of the bidders is owned by someone I used to work with, and I have a personal friendship with them. Do I have to declare it, and what happens if I do not?

I believe a local government body has been consistently favouring one supplier and ignoring its own rules. Is there an independent body I can complain to and what would it investigate? I would appreciate some clarity on what the law actually requires here.

We are a subcontractor working for a company that won a large council contract, and they are delaying our payments. Does the fact that this is a public contract give us any additional protection? I would like to know what steps I should take next to protect myself.

Several firms in my industry regularly talk to each other before tenders, and it seems they take turns winning contracts. I am concerned it is illegal, but I do not want to get in trouble myself. What is the law on this?
