How much notice do I have to give when I resign?

My employer announced a restructure and my role has been disestablished, while a newer colleague doing similar work has been kept on. It feels unfair and no one has explained how the selection was made. What are my rights?
A genuine redundancy is lawful, but the employer must follow a fair and reasonable process. The duty of good faith in the Employment Relations Act 2000 requires the employer to provide you with relevant information about the proposal and the reasons, consult with you before making a final decision, consider your feedback and explore alternatives such as redeployment. The selection criteria should be objective and fairly applied, and if roles are similar, the employer should explain why yours was chosen. Unlike many countries, New Zealand has no statutory redundancy compensation, unless your employment agreement provides for it. You should check your agreement for a redundancy clause. If the process was flawed or the redundancy was not genuine, you can raise a personal grievance within 90 days.
