What is a 90-day trial period and can I challenge a dismissal during it?
- 14.08.2026
A senior colleague constantly belittles me in front of the team, sets impossible deadlines and has made comments that leave me anxious about work. I have complained to HR, but nothing has happened. What can I do?
Workplace bullying can breach several laws. Under the Health and Safety at Work Act 2015, employers must take reasonably practicable steps to manage risks to workers' physical and mental health, which includes bullying and harassment, and WorkSafe has guidance on this. Under the Employment Relations Act 2000, an employer's failure to address bullying can also be an unjustified disadvantage, and serious cases can amount to constructive dismissal. Keep a record of incidents, including dates, witnesses and effects, and put your complaint in writing so that the employer has a clear duty to investigate. If HR does not act, you can raise a personal grievance within 90 days and request free mediation through MBIE. Sexual or racial harassment may also be dealt with under the Human Rights Act 1993. Seek support from a union or a community law centre.
