Employer wants me to sign a new contract with worse terms
- 31.07.2026
I have just told my employer that I am pregnant and expecting to take parental leave. Since then my manager has been cold, changed my duties and hinted that the company cannot manage with someone on leave. Am I protected, and what are my rights?
You have strong legal protection. It is unlawful discrimination under the Human Rights Act 1993 and the Employment Relations Act 2000 to treat you worse, dismiss you or disadvantage you because of pregnancy. You may also be entitled to parental leave under the Parental Leave and Employment Protection Act 1987 if you meet the eligibility requirements. Eligible employees are entitled to up to 26 weeks of paid parental leave, subject to the qualifying period and other conditions, and extended unpaid leave, and generally have the right to return to the same or a similar position. Unfair changes to your duties could be an unjustified disadvantage, and dismissal could be an unjustified dismissal. Keep a diary of the incidents and raise a personal grievance within 90 days, and contact the Human Rights Commission or MBIE for support.
