I recently bought a small boat and plan to take friends fishing. I have heard that as skipper I am personally responsible for everyone on board. What are my legal duties, and what happens if something goes wrong?

The skipper carries primary responsibility for the safety of the vessel and everyone on it. Under the Maritime Transport Act 1994 and the Maritime Rules, including the navigation safety rules, you must operate the boat safely, keep a lookout, carry the required safety equipment, and ensure lifejackets are carried for everyone and worn when there is a risk, such as in a small boat, in rough conditions or when crossing a bar. Regional councils also make navigation safety bylaws, including speed limits near shore. You must not operate a vessel in a way that endangers people, and alcohol or drug impairment can lead to criminal charges. If there is an accident, you may face investigation and prosecution as well as civil claims. Check your local rules and take a boating safety course.
