While refuelling my boat at a wharf, some diesel spilled into the water and a harbour worker said I could be fined. It was a small amount and I tried to clean it up. Is this a serious matter legally? I have never dealt with anything like this before and would like to understand my options clearly.

It can be. Discharging oil or other harmful substances into the marine environment is regulated under the Maritime Transport Act 1994, and there are also provisions under the Resource Management Act 1991 and regional council rules. Even small spills can lead to infringement notices or prosecution, particularly if you failed to report it or take reasonable steps to prevent it. You may need to notify the harbourmaster or regional council of a spill promptly, so do so, and cooperate with any clean-up efforts. Costs of clean-up can be recovered from the person responsible. Use drip trays and spill kits when refuelling, and make sure fuel hoses are properly secured. Check your insurance policy to see if it covers pollution liability, since some marine insurance policies include cover for clean-up costs and third-party claims.
