What should I know before chartering a boat in New Zealand waters?

Read the charter agreement carefully, paying particular attention to the responsibilities and liabilities of the charterer, the deposit or bond, and what insurance is in place. Check whether the operator has appropriate commercial vessel approvals if the charter includes a skipper, and whether you need boating qualifications or a skipper if bareboat. Look for clauses making the charterer liable for all damage regardless of fault, high excess amounts, restrictions on where you can sail, weather cancellation policies and exclusions for negligence. Unfair terms in a standard consumer contract can be challenged under the Fair Trading Act 1986, but it is better to negotiate before signing. Confirm what safety equipment is provided and get a proper briefing. Ask the operator for the insurance certificate and check what excess you will pay.
