While out on the harbour in a small runabout, another boat crossed my path and we collided. Nobody was badly hurt, but both boats were damaged, and we are now arguing over who was at fault. How does the law decide, and what should I do?

Responsibility is decided by applying the collision prevention rules, which in New Zealand are given effect through the Maritime Rules and are based on the international collision regulations, together with the general law of negligence. The rules set out which vessel must give way in crossing, overtaking and head-on situations, and every skipper must keep a proper lookout and maintain a safe speed. Fault can be shared, in which case damages are apportioned. Exchange details with the other skipper, take photographs of the damage and positions, and note witnesses and weather conditions. Report the accident to Maritime New Zealand where the Maritime Transport Act 1994 requires it, especially if there was injury or serious damage, and notify your insurer promptly. Avoid admitting fault at the scene.
