I have a few beers while fishing from my boat and I assumed that the drink-driving laws only apply on roads. A friend says that skippers can be prosecuted for boating drunk. What are the rules for alcohol on the water?

Skippers can be prosecuted. Under the Maritime Transport Act 1994 and the Maritime Rules, a person must not operate a vessel in a manner that causes unnecessary danger or risk, and operating a vessel while impaired by alcohol or drugs can result in prosecution, including for endangering people. Skippers also have to comply with local bylaws and the general duty to keep a proper lookout and operate safely. While the rules do not necessarily specify the same numerical limits as for road drivers in all situations, alcohol affects judgment and reaction times, and evidence of impairment can be used in court. Penalties can include fines and, in serious cases, imprisonment, and any resulting accident may affect your insurance cover. The safest approach is to have a sober skipper.
