Complaint about my own lawyer’s fees, where do I go?
- 06.08.2026
We lost an arbitration and I strongly believe the arbitrator misapplied the law. I would like to appeal to the High Court. Is that possible, and how much room is there to overturn the decision? I have tried asking around but nobody seems to give me a clear answer.
Rights of appeal are limited. Under the Arbitration Act 1996, an award can be set aside by the High Court on narrow grounds, such as invalidity of the arbitration agreement, lack of proper notice or inability to present your case, the award going beyond the scope of the submission, improper procedure or if it conflicts with public policy. An appeal on a question of law is only available if the parties agreed to it in their arbitration agreement or under the rules they adopted, and the court's leave is generally needed. Time limits are short, typically three months, so seek advice immediately. Courts adopt a strongly pro-enforcement approach and rarely interfere just because they might have reached a different result.
