I have a pile of unpaid court fines and I know the court collectors have been in touch. I have been told that people can be jailed for fines. How real is the risk, and what can I do to sort this out? Nobody has given me a straight answer and I want to understand where I actually stand.
The risk is real but there are many steps before imprisonment, which is a last resort. The court collector can arrange payment plans, use attachment orders against wages or bank accounts, seize property or prevent you from leaving the country if the debt is large. In serious cases of persistent non-payment, the court can impose alternative sentences such as community work or, rarely, detention. Contact the collector early to negotiate an affordable payment plan, because refusing to engage is what causes escalation. If you cannot pay because of financial hardship, you can ask the court to remit the fine or convert it into community work under the Criminal Procedure Act 2011.
