We bought a section with a small stream running through it and would like to build a house near the water. Someone told us there are special rules and that we may need to leave a large strip of land empty. What restrictions could apply?

There are usually restrictions. Under the Resource Management Act 1991, district and regional plans often impose setbacks from rivers, streams and the coast, control earthworks and vegetation clearance near water and regulate structures in or over waterbodies. National regulations on freshwater management can also affect works in and around wetlands and streams. Hazard rules, such as flood zones or coastal erosion areas, may require additional design or exclude building altogether. Before purchase or design, obtain the Land Information Memorandum from the council, check the district and regional plans and ask a planner to confirm what is permitted and what needs a resource consent. In some cases, esplanade reserves or strips may be required at subdivision. It is far cheaper to check early than to redesign later.
