Can I get a fine for burning rubbish or a bonfire at home?

Open burning is restricted in many urban areas. Under the Resource Management Act 1991, regional air plans commonly prohibit or restrict outdoor burning within urban zones, particularly for treated timber, plastics, tyres or other materials that release harmful pollutants. In some areas garden waste burning may be allowed only at certain times or with a permit, and Fire and Emergency New Zealand may impose fire bans or restricted seasons under the Forest and Rural Fires Act 1977. Check your council's air plan for what applies. If you believe the infringement notice is wrong, you can request a review or a hearing in court. Repeated breaches or burning hazardous materials can lead to prosecution. Safer alternatives include green waste collection, mulching or transfer stations.
