My 15-year-old was arrested after being caught with a group who broke into a shed. Police want to talk to my child and I do not know what rights they have. Do teenagers appear in the same courts as adults, and what should I be doing?

Young people are usually dealt with differently. Under the Oranga Tamariki Act 1989, offending by children and young people aged 14 to 17 is generally dealt with in the Youth Court, with a focus on accountability, rehabilitation and involving family through a family group conference. The most serious offences, such as murder or manslaughter, may be transferred to the High Court. Your child has the right to remain silent and to consult a lawyer, and police must involve a nominated adult during questioning. Arrange for your child to speak to a youth advocate or lawyer before answering questions, and support them in attending every step. Diversion and restorative processes are often used for first offences to avoid a formal court record.
