I obtained a court judgment against a former customer, but months later I have received nothing. They ignore letters and it is unclear whether they have assets. Winning seems pointless if I cannot collect. What enforcement options do I actually have?

A judgment is only the first step, and enforcement is a separate process. In the District Court and the Disputes Tribunal, enforcement is managed through the court, where you can apply for an attachment order over wages or bank accounts, a charging order over property, or seizure and sale of assets by a bailiff or court collector. You can also apply for an examination of the debtor, requiring them to attend court and answer questions under oath about their income and assets, which is often very effective for locating enforceable assets. If the debtor is a company and the debt is over the threshold, a statutory demand followed by a liquidation application is an option, but it is a serious step. Get advice on the most cost-effective route.

I received a notice from the court that a judicial settlement conference has been scheduled in our case. My lawyer says I must attend in person, but I do not see the point when both sides are so far apart. What happens at one?

My subcontracting business has been waiting on a large unpaid progress payment from a main contractor, who refuses to pay and says it will be resolved later. I have heard that construction disputes have a quick process. How does it work?
