My workplace has said that all staff in my role must be vaccinated against a particular disease or lose their jobs. I am not comfortable with this. Can an employer require this, and what are my rights?

In general, no one can be forced to receive a vaccination, as the Code of Health and Disability Services Consumers' Rights and the New Zealand Bill of Rights Act 1990 protect the right to refuse medical treatment. However, an employer may be able to require vaccination for a particular role if it is reasonable, following a proper health and safety risk assessment, and after consultation with affected workers, and if the requirement is in a lawful order or properly incorporated into the employment agreement. The employer must consider alternatives, such as redeployment or other controls. A dismissal on this basis would need to be justified and follow a fair process under the Employment Relations Act 2000. Ask the employer for the risk assessment and policy, and seek advice from a lawyer or union before agreeing to anything.

My employer phoned my doctor's clinic and apparently received details about a health problem. I never gave permission and I feel humiliated. Is this a breach of confidentiality, and what can I do? I am not sure where to start or who I should be contacting about this.

My father has advanced dementia and the hospital needs to make a decision about a serious operation. He never signed any legal documents about who should decide. Who has authority to consent for him? Nobody has given me a straight answer and I want to understand where I actually stand.
