Can my doctor share my information with my family or employer?

Health information is highly protected. Under the Health Information Privacy Code 2020, providers must not disclose your health information to others unless an exception applies, such as your authorisation, the disclosure being one of the purposes for which the information was obtained, or a serious threat to health or safety. A clinic that discloses information to an employer without your consent is likely to have breached your privacy, and Right 1 of the Code of Rights also protects the right to be treated with respect. Ask the clinic what was disclosed and by whom, and make a complaint to the clinic's privacy officer. You can complain to the Privacy Commissioner, and to the Health and Disability Commissioner, and in some cases you may be able to claim compensation for harm or humiliation through the Human Rights Review Tribunal.
