Two officers came to my door and asked me to come to the station for a voluntary chat about an incident that happened at a party. They said it would be easier if I just explained my side. I am nervous about saying something wrong. Do I have to go, and should I speak to them?

If you have not been arrested or detained, you are not obliged to go to the station or answer questions, and you have a right to silence. The New Zealand Bill of Rights Act 1990 also gives you the right to consult and instruct a lawyer without delay if you are arrested or detained. If you agree to be interviewed, it is a good idea to speak to a lawyer first, because what you say can be used as evidence. A lawyer can tell you whether you should say anything, prepare a written statement or attend the interview with you. Being polite and clear that you wish to get legal advice first is not an admission of guilt. If you are unsure of your status, ask directly whether you are free to leave.
