Construction work next door begins very early and includes loud machinery and weekend activity. We have asked the builders to stop, but they say they are allowed to work. What limits apply to construction noise?
Construction noise is regulated by the New Zealand Standard for construction noise, NZS 6803, which many district plans and consents adopt, as well as by consent conditions and the Resource Management Act 1991 duty to avoid unreasonable noise. Typical rules restrict work to particular hours, often weekdays and limited Saturday hours, and set noise limits measured at the boundary of neighbouring properties. Check the site's consent conditions or building consent, which can be requested from the council. If noise exceeds the limits, contact the council's noise control officer, who can issue an excessive noise direction, and record dates, times and recordings. Persistent breaches can lead to abatement notices or fines. Talking with the site manager politely before formal steps often produces changes.
