We have been collecting shellfish and fishing on the coast, and a stranger said I was over the limit and that rules vary by area. I do not want to get in trouble. What rules should I check and what happens if I breach them?
Recreational fishing rules are set under the Fisheries Act 1996 and its regulations, and they include daily bag limits, minimum size limits and restrictions in particular areas, such as marine reserves, mataitai reserves and temporary closures. Limits differ by species and region, so check the Ministry for Primary Industries rules or the NZ Fishing Rules app before you head out. Fishery officers can inspect your catch and equipment, and breaches can lead to infringement fines, seizure of gear and prosecution for serious or repeated offending, particularly for taking excess amounts or selling catch. Customary fishing rights of tangata whenua are governed by separate regulations and require authorisation. If you receive a notice, you can dispute it, but it is better to know the limits and keep within them.
