I want a full copy of my medical file from my GP and the hospital, but the practice says it needs to charge a large fee and that some notes cannot be released. Do I have a right to see my own health information?
Yes. Under the Privacy Act 2020 and the Health Information Privacy Code 2020, you have a right of access to health information held about you, and providers must respond as soon as reasonably practicable, and no later than 20 working days. They generally cannot charge you to access your own information, although they may charge for certain cases, such as if a large amount of photocopying is required. Information can be withheld only for specific reasons set out in the Act, such as where disclosure would endanger safety, involve an unwarranted breach of another person's privacy or reveal a confidential source. Make your request in writing, describing what you want. If you are refused or overcharged, complain to the provider's privacy officer and then to the Privacy Commissioner.
