After a landslip damaged part of our property, I was told that a government body covers natural disaster damage before my private insurer does. I do not understand what is covered and who I should claim from first.

Natural disaster cover is provided by the Natural Hazards Commission Toka Tū Ake, formerly the Earthquake Commission, under the Natural Hazards Insurance Act 2023. It provides cover for residential buildings, and for some residential land, for damage from natural hazards such as earthquakes, natural landslips, volcanic eruptions, hydrothermal activity and tsunami, and it is generally automatically included if you have a private home insurance policy with fire cover. There are caps on the amount payable, which have changed over time, and a separate amount for land in specific situations. Your private insurer generally covers damage above the cap. Lodge your claim with the Commission and tell your insurer, and keep records, photographs and repair quotes. Check the current caps, which changed in the past few years, and whether contents cover is available.

Our home was badly damaged by fire and the insurer says the cost to rebuild is higher than my sum insured, and that they will only pay up to that amount or reduce the claim proportionally. Was I supposed to have been told about this, and what are my rights?
