I used a rideshare app and the driver drove dangerously, ran red lights and was clearly distracted by their phone. I felt unsafe throughout the trip. What can I do about this, and is the platform responsible for the driver’s conduct?
As a passenger, you have rights both under general consumer protection law and through the specific regulatory regime for small passenger services under the Land Transport Act 1998 and associated rules, which require drivers to hold the appropriate licence endorsement, undergo safety checks and comply with safe driving requirements. Dangerous driving may itself be a criminal offence, and you can report the specific incident to police, providing the trip details, time and any dashcam or app records. You can also report the driver directly to the rideshare platform, which typically has its own safety reporting and review processes and may deactivate drivers for serious breaches, since operators have obligations relating to driver conduct under transport regulation. If you suffered injury as a result, you can generally make a claim through ACC. Keep a record of the trip details from the app, including the date, time and driver information, to support any report.
