I bought a car from a private seller after viewing it twice. The seller said it had never been in an accident, but a repairer has now found evidence of serious past crash repairs. The seller is not answering my messages. Can I get my money back given it was not a dealer sale?

A private sale is not covered by the Consumer Guarantees Act, but you are not without remedies. If the seller made a false statement of fact that induced you to buy, such as that the car had never been in an accident, the Contract and Commercial Law Act 2017 allows you to cancel the contract and claim damages for misrepresentation, provided you act within a reasonable time after discovering it. You will need evidence of what was said, so keep the advertisement, messages and any repair report. The Fair Trading Act mainly applies to people acting in trade, so it may not help unless the seller regularly sells cars. Send a written notice of cancellation or claim, and if there is no response, the Disputes Tribunal is the practical forum for a claim within its monetary limit.
