I run a small cafe and signed a standard supplier agreement for equipment leasing. Later I noticed the supplier can change the price whenever it wants and can end the contract at any time, but I am locked in for years with hefty exit fees. Do small businesses have any protection against terms like this?

Yes, to a limited extent. Since the Fair Trading Act 1986 was amended, the unfair contract terms rules extend to small trade contracts as well as consumer contracts. A small trade contract is a standard form contract where each party is in trade and the annual value is at or below a set threshold, currently around 250,000 dollars. A term is unfair if it causes a significant imbalance, is not reasonably necessary to protect the supplier's legitimate interests and would cause you detriment. Terms allowing one party to vary the price or exit at will while the other is locked in are typical examples. Only a court can declare a term unfair, and the Commerce Commission generally brings the case, so gather the contract and evidence of the impact and lodge a complaint. Get legal advice before withholding payments.

I paid a repairer a hefty amount to fix my dishwasher. It broke down again within days, and the repairer said the new fault was unrelated and wanted another call-out fee. I feel the job was done poorly. Do I have any rights when the goods are not the problem but the service is?

I took out a personal loan and the lender approved it after a five-minute online application without asking much about my expenses. Within months I was struggling with the repayments and my other debts. Shouldn't a lender have checked that I could afford it, and do I have any recourse?

My gym membership had a minimum term that finished months ago, but the gym says I need to give notice in person during staffed hours, which are impossible with my work. They keep charging me weekly. I tried emailing to cancel and they ignored it. Can they really force me to keep paying?

I was given a spa voucher as a present and put it in a drawer. When I finally tried to book, the business said it had expired the month before and refused to honour it. There was no expiry date printed on the voucher itself, only on their website. Can they do that?

I paid a premium for cleaning products labelled as planet-friendly and carbon neutral. The company gives no explanation on how these claims are measured, and a friend who works in the industry says the ingredients are quite ordinary. Is this false advertising, and who can I complain to?
